As a general rule, the mandate of the court is to protect the best interests of the child in matters of custody. That decision is often based on the arrangements already established during a marriage or separation, but there is much room for negotiation. While there are guidelines for determining support, no two families and no two cases are the same.

Most commonly, parents are negotiating for some arrangement involving:

  • Physical Custody – provides that the child will live with you and you will have the parental rights recognized by legal custody.
  • Legal Custody – grants you all normal parental rights except the right to provide the primary residence.
  • Joint Custody – parents share equal parental rights and responsibilities.
  • Sole Custody – is far less common, but may be granted if the other parent has a history of abuse, violence or criminal activity.
  • Visitation – is an arrangement to grant limited access to your children.
